Nature of grievance

When the Offences alleged are only “Bailable” in the FIR, then the officer In-charge of the Police Station is empowered to grant Bail to the Accused person; (Section 436)

The officers In-charge of the Police station, are further empowered to grant Bail in Non-bailable offence cases, where if it appears to such officer, at any stage of the investigation, that there are no reasonable grounds for believing that the accused has committed a non-bailable offence, but that there are sufficient grounds for further inquiry into his guilt, the accused person may be released on Bail, whilst recording in writing his reasons or special reasons for so doing, on the execution by the Accused, of a bond without sureties for his appearance. (Section 169, 437)
