Nature of grievance

SUIT FOR POSSESSION OF IMMOVABLE PROPERTY BASED ON PREVIOUS POSSESSION AND NOT ON TITLE, WHEN THE PLAINTIFF WHILE IN POSSESSION OF THE PROPERTY HAS BEEN DISPOSSESSED: Where a Person is dispossessed from the property, without due process of law, a suit u/s 6 of Specific Relief Act, 1963, may be filed within six months from the date of dispossession, before the District Court/ City Civil Court / High Court, for immediate restoration of possession to the person who was in lawful possession; A Suit may also be filed under Article 64 of the Limitation Act, 1963, within 12 years from the date of dispossession, for restoration of possession of the concerned property
